Pro Custom Solar alleged to have invaded man's privacy with unwanted calls

LOS ANGELES (Legal Newsline) – A California man alleges a solar panel installation company unlawfully made telemarketing calls to consumers.

Kevin Amini filed a complaint individually and on behalf of all others similarly situated on Dec. 26, 2017, in the U.S. District Court for the Central District of California against Pro Custom Solar LLC, doing business as Momentum Solar, alleging violation of the Telephone Consumer Protection Act.

According to the complaint, on Oct. 10, 2017, the plaintiff received a sales call from the defendant to his cellphone that was made with an autodialing system. He alleges his privacy was invaded by the call.

The plaintiffs hold Pro Custom Solar LLC responsible because the defendant allegedly initiated marketing telephone calls without consent from plaintiffs and while utilizing an unlawful pre-recorded voice and an automatic telephone dialing system.

The plaintiffs request a trial by jury and seek judgment against defendant, award statutory damages, interest, injunctive relief, to certify the class action, appoint class representative and class counsel, and further relief as may be just and proper. He is represented by Joshua B. Swigart and Yana A. Hart of Hyde and Swigart APC in San Diego, California.
