SAN JOSE, Calif. (Legal Newsline) – A California patent and trademark law firm alleges an online service engaged in patent and trademark filing uses false and misleading advertising.

LegalForce RAPC World PC, LegalForce Inc. and Raj V. Abhyanker filed a complaint on Dec. 26, 2017 in the U.S. District Court for the Northern District of California, San Jose Division against Trademark Engine LLC, Travis Crabtree, and Gray Reed & McGraw PC alleging unfair competition, professional negligence and other counts.

According to the complaint, the plaintiffs allege that the defendants are harming the public interest because they makes consumers susceptible to the risk of bad legal advice when they prepare and file trademarks. The plaintiffs allege that Trademark Engine LLC is not a law firm and because it is not, no regulatory protections are in place.

The plaintiffs alleges the defendants made false and/or misleading statements of fact concerning the non-attorney nature of its services and products in its online advertising and promotions, while giving legal advice through non-attorneys and covertly hiding the identity of its owner.

The plaintiffs request a trial by jury and seek costs, prejudgment interest, attorneys' fees, and other applicable statutes. They are represented by Raj V. Abhyanker and Batkhand Zoljargal of LegalForce RAPC Worldwide PC in Mountain View, California.
