Consumer alleges Buffalo Wild Wings, others sent him unwanted text messages

SAN FRANCISCO (Legal Newsline) – A consumer has filed a class-action lawsuit against a restaurant chain and other entities over allegations it sent him text message advertisements without his consent.

Marche Meeks, on behalf of himself and others similarly situated, filed a complaint on Oct. 10 in the San Francisco Superior Court against Buffalo Wild Wings Inc., Blazin Wings Inc., Yelp Inc., Nowait Inc., Wingmen V LLC, and Does 1 through 50 for alleged violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in July and September 2017, after visiting a Buffalo Wild Wings restaurant, plaintiff was asked to provide his number while waiting for his table. Shortly after both visits, he alleges he received numerous text advertising defendants' various services and products. Plaintiff alleges he did not give defendants' his prior express written consent to receive numerous text advertisements. 

The plaintiff requests a trial by jury and seeks judgment for statutory, compensatory, special, general and punitive damages, pre and post-judgment interest, and for such other and further relief as may be deemed necessary or appropriate. He is represented by Anthony J. Orshansky, Alexandria Kachadoorian and Justin Kachadoorian of Counselone PC in Beverly Hills, California.

The case was later transferred to the U.S. District Court for the North District of California on Dec. 14.
