ORLANDO (Legal Newsline) – An England resident alleges car rental companies did not provide liability insurance despite customers paying for it.
John Ball, individually and on behalf of all others similarly situated, filed a complaint on Dec. 19 in the U.S. District Court for the Middle District of Florida, Orlando Division against Alamo Rent A Car LLC, Enterprise Holdings Inc. and Enterprise Leasing Co. of Orlando LLC over alleged violation of the Florida's Deceptive and Unfair Trade Practices Act.
According to the complaint, the plaintiff alleges that between 2012 and 2017, he entered into 11 separate car rental contracts with defendants. He alleges the defendants promised to include supplemental liability insurance as a part of the rate he paid, but no such insurance was provided.
The plaintiff alleges the defendants breached the contract agreement by failing to provide insurance and "procured tens of millions of dollars at the expense of international inbound renters, who have little to no ability to investigate the deceptive practice or illuminate the illegal practice."
The plaintiff requests a trial by jury and seeks judgment for compensatory damages, costs, attorney fees and grant other such relief as deemed applicable. He is represented by Edmund A.
