Consumer claims Crisco spray is falsely represented as 100 percent extra virgin olive oil

LOS ANGELES (Legal Newsline) – A California consumer has filed a class-action lawsuit over allegations that an olive oil spray is not 100 percent olive oil as advertised.

Joshua Joseph, individually and on behalf of all others similarly situated, filed a complaint on Dec. 4 in the U.S. District Court for the Central District of California against The J.M. Smucker Co. for alleged violation of California's Consumers Legal Remedies Act and California's False Advertising Law.

According to the complaint, Joseph alleges that in February, he purchased the defendant's Crisco 100 percent Extra Virgin Olive Oil No Stick Spray, relying on the product's representation that it was comprised solely of extra virgin olive oil with no additional ingredients. However, plaintiff claims the product's representation was false and misleading as it contains soy lecithin, dimethyl silicone and propellant chemicals and is not 100 percent olive oil.

The plaintiff alleges that had he known the product contained additional ingredients, he would not have purchased it or paid less for it.

The plaintiff requests a trial by jury and seeks damages, prejudgment interest, economic losses, order of restitution, injunctive relief and for any such relief as the court deems just and proper. He is represented by Benjamin Heikali of Faruqi & Faruqi LLC in Los Angeles.
