LOS ANGELES (Legal Newsline) – A consumer claims a popular children's multivitamin supplement does not contain four vitamins despite being marketed as a "complete" supplement.
Camille Cabrera, individually and on behalf of all others similarly situated, filed a complaint on Nov. 22 in the U.S. District Court for the Central District of California against Bayer Healthcare LLC and Bayer Corp. citing common law fraud, intentional misrepresentation and other counts.
According to the complaint, the plaintiff alleges that in March 2017, she purchased the defendants' Flintstones Gummies complete children's multivitamin supplement, reasonably relying on the defendants' "complete" representation on the product and believing that the product contained all the vitamins. The plaintiff alleges that the products do not contain vitamins K, B1 (thiamine), B2 (riboflavin) and B3 (niacin).
The plaintiff holds Bayer Healthcare LLC and Bayer Corp. responsible because the products allegedly failed to conform to the statement of quality labels because the products are not complete multivitamin supplements as represented.
The plaintiff requests a trial by jury and seeks an order awarding all damages, prejudgment interest, injunctive relief and for any such relief as the court deems just and proper. She is represented by Benjamin Heikali of Faruqi & Faruqi LLP in Los Angeles.
