BROOKLYN, N.Y. (Legal Newsline) – A New York consumer claims that he paid a premium price for a chicken product at McDonald's that is misrepresented as being 100 percent chicken breast.

King Ho Yip filed a complaint on behalf of himself and others similarly situated on Nov. 13 in the U.S. District Court for the Eastern District of New York against McDonald's Corp. and McDonald's USA LLC citing violation of New York's Consumer Fraud and Deceptive Trade Practices Acts and other counts.

According to the complaint, the plaintiff alleges that McDonald's advertises that its artisan grilled chicken is 100 percent chicken breast. The plaintiff claims that this advertising campaign is false because the chicken breast fillets contain rib meat as well.

The plaintiffs hold McDonald's Corp. and McDonald's USA LLC responsible because the defendants allegedly disseminated false and misleading advertising messages.

The plaintiffs request a trial by jury and seek judgment against defendants for monetary, compensatory, treble and punitive damages, injunctive relief, restitution and disgorgement of all profits obtained by unlawful means, interest, attorneys’ fees and costs.
