Search Engine Listing alleged to have solicited consumer registered on Do-Not-Call list

LOS ANGELES (Legal Newsline) – A Studio City, California individual has filed a class action lawsuit against an online marketing company over allegedly unlawful calls to solicit its services.

John Sloatman III, individually and on behalf of all others similarly situated, filed a complaint on Oct. 31 in the U.S. District Court for the Central District of California against Search Engine Listing Inc. and Does 1 through 10, inclusive, alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in December 2016, he was contacted by the defendants via an automatic telephone dialing system in an attempt to solicit him to purchase its services. The plaintiff claims he registered his telephone number on the National Do-Not-Call Registry prior to receiving the calls but still received calls from the defendant without his prior express consent. 

The plaintiff holds Search Engine Listing Inc. responsible because the defendant allegedly failed to establish and implement reasonable practices and procedures to effectively prevent telephone solicitations in violation of the regulation prescribed under the law.

The plaintiff requests a trial by jury and seeks an award of treble and statutory damages for each and every violation and all other relief that the court deems just and proper.
