Consumer claims brand of Pampers baby wipes are not 'natural' as advertised

WHITE PLAINS, N.Y. (Legal Newsline) – A New York consumer alleges a brand of baby wipes is deceptively marketing as providing a natural clean.

Tyoka Brumfield, individually and on behalf of all others similarly situated, filed a complaint on Oct. 20 in the U.S. District Court for the Southern District of New York against Procter & Gamble Co. alleging deceptive acts or practices, false advertising and other counts.

According to the complaint, the plaintiff alleges that between 2014 and 2017, she purchased the defendant's Pampers Natural Clean wipes. The suit states the product is marketed by the defendant "to be a natural and safer alternative to traditional wipes."

The plaintiff alleges that the wipes are not natural because they contain a preservative called phenoxyethanol, xantham gum and other ingredients. She alleges she would not have purchased the product had she known the statements she relied on were misleading and false.

The plaintiff requests a trial by jury and seeks award for compensatory, statutory, and punitive damages; prejudgment interest; injunctive relief; attorneys' fees; expenses and costs of suit. She is represented by Scott A. Bursor, Joseph I. Marchese, Neal J. Deckant, Yitzchak Kopel and Frederick J. Klorczyk III of Bursor & Fisher, PA in New York.
