Fimd Now Inc. accused of telephone harassment

LOS ANGELES (Legal Newsline)— A Chatsworth woman has filed a class action lawsuit against a lending company, citing alleged violation of telephone harassment statutes.

Tenley Hardin, individually and on behalf of all others similarly situated, filed a complaint on Oct. 16 in the U.S. District Court for the Central District of California against Fund Now Inc. and others for alleged violations of the Telephone Consumer Protection Act (TCPA).

According to the complaint, Hardin alleges that, in July 2017, she was contacted by the defendant on her cellular phone in an attempt to solicit her to purchase its services. The plaintiff claims the defendants used an automatic telephone dialing system and did not have her prior consent before calling. 

As a result, Hardin and the class lost time for nonemergency matters and incurred charge for incoming calls. 

The plaintiff alleges the defendants used an automatic telephone dialing system or an artificial or prerecorded voice without prior consent.

The plaintiff requests a trial by jury and seeks treble damages, statutory damages and any other relief that the court deems proper. He is represented by Todd M. Friedman, Adrian R. Bacon and Meghan E. George of the Law Offices of Todd M. Friedman PC in Woodland Hills, Calif.
