Consumers claim Reservations.com charged hidden fee

ORLANDO, Fla. (Legal Newsline) – A hotel booking company is alleged to use unfair and deceptive marketing practices.

Michael Marko and Mike's Inc., individually and on behalf of all others similarly situated, filed a complaint on Oct. 4 in the U.S. District Court for the Middle District of Florida, Orlando Division against Benjamin & Bros. LLC, doing business as Reservations.com, alleging breach of contract, violation of Florida Unfair and Deceptive Trade Practices Act.

According to the complaint, the plaintiffs allege that on Nov. 28, 2016, they booked a group of hotel rooms through the defendant by way of telephone. The plaintiffs claim they never received an email confirmation or receipt after the rooms were booked. The suit states that when the plaintiffs later needed to cancel one room, they could not do so because they did not have the confirmation email and could not cancel through the hotel directly. 

They also allege they were charged a $14.99 hidden fee for each room that the defendant did not disclose.

The plaintiffs hold the defendant responsible because the defendant allegedly charged the plaintiffs more than the advertised rate, failed to issue a refund when a room was canceled.

The plaintiffs request a trial by jury and seek award of actual, compensatory, punitive and exemplary damages, prejudgment interest, costs, expenses, and such other relief as the court deems just and proper. They are represented by Jason K. Whittemore of Wagner McLaughlin PC in Tampa, Florida.
