Lawsuit: Haynes Furniture Co. Inc. discount prices are exaggerated

CAMDEN, N.J. (Legal Newsline) – A New Jersey man alleges that an indoor/outdoor household furnishings business is "defrauding" customers into buying products at fictitious discount prices.

Anthony F. Degennaro filed a complaint on behalf of himself and all others similarly situated on Aug. 14 in the Superior Court of New Jersey Gloucester Vicinage, Law Division against Haynes Furniture Co. Inc., John and Jane Does 1-10 et al. citing the New Jersey Consumer Fraud Act and other counts.

According to the complaint, the plaintiff alleges that the defendants violated the law "by advertising inflated and fictitious market or retail prices and, upon which their 'discounted prices' are based." He alleges these discounts are "grossly exaggerated."

The plaintiffs hold Haynes Furniture Co. Inc., John and Jane Does 1-10, et al. responsible because the defendants allegedly induced consumers to purchase items that they falsely advertised as discounted, received the benefit conferred upon them by the consumers and failed to comply with their warranty of providing discounted price.

The plaintiffs request a trial by jury and seek judgment against defendants for compensatory, consequential, actual, statutory, exemplary, punitive and treble damages; appointment of class representative and counsel; civil penalties; interest; attorneys' fees; costs; and further relief as the court deems just. He is represented by Tyler T. Prime and Duncan M. Prime of Prime Law in Mount Laurel, New Jersey.

The defendant removed the case to U.S. District Court for the District of New Jersey on Sept. 21.
