Consumer alleges reference price used at Fossil Outlet stores is false

SAN DIEGO (Legal Newsline) – A San Diego man alleges an outlet store uses a fraudulent business practice known as false reference pricing to make it seem that consumers are getting a discount.

Timur Safransky filed a complaint on behalf of himself and all others similarly situated on Sept. 13 in the U.S. District Court for the Southern District of California against Fossil Group Inc., Fossil Stores I Inc. and Does 1 through 100 citing the California False Advertising Law and other counts.

According to the complaint, the plaintiff alleges that he suffered monetary damages when he purchased a Fossil Outlet Product form the Carlsbad, California Fossil Outlet Store in November 2016.

He alleges he was damaged because the defendants "would offer substantial discounts off a false 'reference price' listed on the price tags of Fossil Outlet Products," the suit states. The plaintiff alleges that these reference prices were overstated and only used "to perpetuate defendants' fake-discount scheme," the suit states.

The plaintiff requests a trial by jury and seeks restitution and disgorgement, order the defendants to engage in a corrective advertising, all legal fees, interest and any other relief as the court deems just.
