Woman alleges Rite Aid's after sun gel does not contain aloe as listed on label

LOS ANGELES (Legal Newsline) – A Los Angeles woman alleges that an aloe vera product she purchased at a pharmacy chain does not contain aloe vera.

Tina Kalajian filed a complaint on behalf of herself and a class of similarly situated individuals on Sept. 14 in the U.S. District Court for the Central District of California against Rite Aid Corp. and Does 1 through 100 alleging breach of express warranty and other counts.

According to the complaint, the plaintiff purchased the defendants' Rite Aid Renewal After Sun Gel and that the product's label states it contains aloe barbadensis leaf juice powder. She alleges independent lab tests determined the product contains no aloe vera at all.

The plaintiff holds Rite Aid Corp. and Does 1 through 100 responsible because the defendants allegedly breached the express warranties by producing and distributing products that do not conform to the promises or descriptions on the packaging.

The plaintiff requests a trial by jury and seeks actual damages, injunction against the defendants, all legal fees, disgorgement, interest and any other relief as this court deems just. She is represented by Gerald B. Malanga of Lattie Malanga Libertino LLP in Los Angeles.
