Consumer accuses food business of false advertising

SAN DIEGO (Legal Newsline) — A California man has filed a class action lawsuit against a food business, alleging negligent misrepresentation.

Anthony Buso filed a complaint, individually and on behalf of all others similarly situated, Sept. 14 in U.S. District Court for the Southern District of California against ACH Food Companies Inc., and Does 1 through 10, alleging that they sell their products with approximately 50 percent empty space.

According to the complaint, the plaintiff alleges that he suffered damages from purchasing a falsely advertised Fleischman's Simply Homemade Baking Mix product for cornbread. The plaintiff alleges the defendants sells their baking mix cornbread product that had more than 50 percent empty space or slack fill.

Buso seeks trial by jury, injunctive relief, legal fees, interest, exemplary and punitive damages, compensatory damages, and all other relief the court deems just. He is represented by attorney Scott J. Ferrell of Pacific Trial Attorneys in Newport Beach, California.
