Lawsuit: FGF Brands' naan is not baked in tandoor oven as advertised

RIVERSIDE, Calif. (Legal Newsline) – A consumer claims she was "duped" into buying a particular brand of naan bread because of its false representations that it was baked in a tandoor oven.

Hortense Sims filed a complaint on behalf of himself and all others similarly situated and the general public on Aug. 3 in Riverside County Superior Court against FGF Brands (USA) Inc., and FGF Brands Inc. citing California's False Advertising Law and other counts.

According to the complaint, the defendant advertises its naan as being baked in a tandoor oven but the plaintiff alleges this is false and misleading. The suit states that the defendants' naan is baked in a commercial cooking system known as a tunnel oven, "with steps taken in the production process to mimic the flavor and appearance of traditional, tandoor-baked naan."

The plaintiff requests a trial by jury and seeks injunctive relief, damages, restitution, all legal fees, interest and any other relief as the court deems just. She is represented by Ronald A. Marron, Kas L. Gallucci, and Michael Houchin of Law Offices of Ronald A. Marron APLC in San Diego.

The defendant removed the case to the U.S. District Court for the Central District of California on Sept. 7.
