Restaurant sued for advertising specials via text message

NEW YORK (Legal Newsline) – A New York restaurant and bar is alleged to have sent unwanted texts advertising specials.

Meghan George filed a complaint on behalf of herself and all others similarly situated on Sept. 1 in the U.S. District Court for the Southern District of New York against Shamrock Saloon II LLC, doing business as Calico Jack's Cantina; Blitz Marketing LLC; John L. Sullivan; and Does 1 through 20 alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that beginning in December 2015, she received text messages from the defendants advertising food and drink specials at Calico Jack's.

The plaintiff holds Shamrock Saloon II LLC, Blitz Marketing LLC, Sullivan and Does 1 through 20 responsible because the defendants allegedly continued to send messages after she attempted to opt out of receiving them and that the defendants sent them without her prior express consent.

The plaintiff requests a trial by jury and seeks statutory damages, enjoin the defendant, all legal fees and any other relief as the court deems just. She is represented by Scott D. Kagan and Terrence E. McCartney of Reiner Slaughter McCartney & Frankel LLP in Rye, New York.
