BAKERSFIELD, Calif. (Legal Newsline) – A consumer claims Home Depot misrepresented the kind and quality of wood it sold.

Clyde Golden filed a complaint on behalf of all others similarly situated on Aug. 30 in the U.S. District Court for the Eastern District of California against Home Depot U.S.A. Inc. alleging violation of the California False Advertising Law and other counts.

According to the complaint, the plaintiff alleges that the defendant markets wood products as mahogany that are in fact made of other species of wood. The suit states he purchased strips from Home Depot in July he believed to be genuine mahogany but were actually a species of eucalyptus.

The plaintiff requests a trial by jury and seeks restitution, disgorgement of all profits, enjoin the defendant, all legal fees and interest and any other relief as the court deems just. He is represented by Keith Altman, Solomon Radner and Ari Kresch of Excolo Law PLLC in Southfield, Michigan.
