Actor alleges HomeAdvisor unlawfully used photos in video advertisements

CHICAGO (Legal Newsline) – An actor known in the Chicago entertainment community alleges that his likeness was used in commercials to promote a home improvement enterprise without his consent.

Ray Alan Bovinett, trading as Alan Bovinett, filed a complaint on Aug. 28 in the U.S. District Court for the Northern District of Illinois, Eastern Division against HomeAdvisor Inc., Angi Homeservices Inc., Hawthorne Direct LLC and Doe 1 through Doe V alleging fraudulent inducement and other counts.

According to the complaint, the plaintiff is professionally engaged as a model and actor and that in 2014, he was photographed by HomeAdvisor's photographer for a print campaign.

The plaintiff holds HomeAdvisor Inc., Angi Homeservices Inc., Hawthorne Direct LLC and Doe 1 through Doe V responsible because HomeAdvisor allegedly used the photographs in video-based commercials in violations of the limitations of the plaintiff's consent.

The plaintiff requests a trial by jury and seeks damages in an amount not less than $2.8 million, all legal fees and any other relief as the court deems just. He is represented by Mark Barinholtz of Mark H. Barinholtz PC in Chicago.
