Consumers claim 'natural' label on Scott flushable wipes is misleading

NEW YORK (Legal Newsline) – A New York consumer and a California consumer allege that Scott Naturals Flushable Cleansing Cloths are falsely advertised as "natural."

Heidi Arreola and Tim Dostal filed a complaint on behalf of all others similarly situated on July 7 in the U.S. District Court for the Southern District of New York against Kimberly-Clark Corp. alleging violation of New York business laws and the California Consumer Legal Remedies Act, plus other counts.

According to the complaint, the plaintiffs allege that the defendant's cleansing cloths are falsely advertised as natural because the product contains non-natural, synthetic ingredients such as sodium chloride, lauryl glucoside and malic acid. They allege they paid a premium for the product on the belief that it is natural.

The plaintiffs holds Kimberly -Clark Corp. responsible because the defendant allegedly misleads consumers by putting the label "natural" on its products despite knowing that it contains non-natural and synthetic ingredients.

The plaintiffs request a trial by jury and seek preliminary and injunctive relief, monetary damages, treble damages, punitive damages, court costs and any further relief the court grants. They are represented by Jason P. Sultzer, Joseph Lipari and Adam Gonnelli of The Sultzer Law Group, P.C. in Poughkeepsie, New York.
