Veggie Straws don't contain veggies on package, lawsuit claims

ALBANY, N.Y. (Legal Newsline) — Two consumers have filed a class action lawsuit against a food business, alleging negligent misrepresentation.

John Solak and Jim Figger filed a complaint, individually and on behalf of all others similarly situated, on June 29, in the U.S. District Court for the Northern District of New York against The Hain Celestial Group Inc. doing business as Sensible Portions, alleging the defendant made false claims regarding the actual contents of its Garden Veggie Straws products.

According to the complaint, Solak and Figger were damaged monetarily from purchasing a falsely labeled product. The plaintiffs allege Sensible Portions displayed pictures of actual vegetables on the package of its Garden Veggie Straws in order to entice consumers to buy the product despite the product not containing any of those vegetables.

Solak and Figger seek trial by jury, injunctive relief, statutory, compensatory, treble and punitive damages, restitution, attorney fees and all other relief the court deems just and proper. They are represented by attorney Sergei Lemberg of Lemberg Law, LLC in Wilton, Connecticut.
