LOS ANGELES (Legal Newsline) — A California couple have filed a class action lawsuit against Tesla, alleging breach of implied warranty, breach of warranty, fraud and negligent misrepresentation.
Roy Wiseman and Marites Wiseman of Los Angeles County filed a complaint, individually and on behalf of all others similarly situated, June 29 in U.S. District Court for the Central District of California against Tesla Inc. and Does 1 through 100, alleging they manufactured and sold defective vehicles across the United States.
According to the complaint, the Wisemans were damaged monetarily from purchasing a new 2016 Tesla Model X vehicle that had a defective braking system. The plaintiffs allege Tesla failed to fix the issues surrounding the enhanced autopilot and regenerative braking limitations found on its Model S and Model X.
The Wisemans seek trial by jury, actual damages, consequential damages, restitution, interest, court costs, enjoin the defendant, and any further relief the court grants. They are represented by attorney Hovanes Margarian of The Margarian Law Firm in Glendale, California.
