SAN FRANCISCO (Legal Newsline) — A consumer has filed a class action lawsuit against the Haagen-Dazs Shoppe Company Inc., Nestle Dreyer's Ice Cream Company, Nestle USA Inc. and Does 1 through 50 for allegedly violating telephone harassment statutes.
Melanie G. San Pedro-Salcedo initially filed the complaint on May 18 in Santa Clara Superior Court, alleging that the defendants sent her several unsolicited text messages. But the defendants removed the U.S. District Court for the Northern District of California on June 16.
According to the complaint, the plaintiff alleges that she suffered damages from receiving several unwanted text messages. The plaintiff holds the defendants responsible for allegedly continuing to sending her text messages despite her request to stop.
The plaintiff requests a trial by jury and seeks statutory treble damages, interest, all legal fees and any other relief this court deems just. She is represented by Miles M. Cooley of Jaurigue Law Group in Los Angeles.
