Federal government and Iowa, Mississippi and Montana say DuPont-Dow merger violates Clayton Act

WASHINGTON (Legal Newsline) — The federal government and several states are suing The Dow Chemical Company and E.I. Du Pont De Nemours and Company, alleging the proposed merger between the two companies would violate federal law.

The United States of America, the State of Iowa, the State of Mississippi and the State of Montana filed a complaint on June 15 in U.S. District Court for the District of Columbia against the defendants alleging that they are attempting to merge in order to eliminate competition.

According to the complaint, the plaintiffs allege that they suffered damages on behalf of the public that will be negatively impacted by the elimination of competition in the chemical market. The plaintiffs hold Dow and DuPont responsible because the defendants allegedly attempted to eliminate competition by merging, in violation of the Clayton Act.

The plaintiffs seek injunction against the defendant, costs of this action and other and further relief as the court may deem just and proper. They are represented by Lowell R. Stern, Don P. Amlin et al. of the U.S. Department of Justice Antitrust Division, Litigation II Section, in Washington, D.C..
