LOS ANGELES (Legal Newsline) — A consumer has filed a class action lawsuit against Brooks Brothers Group Inc., alleging breach of contract, fraud, invasion of privacy, negligence and unfair competition.
Scott Ables filed a complaint on behalf of all others similarly situated on June 9 in U.S. District Court for the Central District of California against Brooks Brothers alleging that the New York outfitter allowed third parties to collect their customers' data.
According to the complaint, the plaintiff alleges that he was damaged from having his personal data collected without his consent. The plaintiff holds Brooks Brothers responsible because it allegedly failed to inform the plaintiff and their other consumers that their personal data was being sent to a third party.
The plaintiff requests a trial by jury and seeks injunction against the defendant, equitable relief, restitution and disgorgement, actual damages, compensatory damages, court costs and any further relief this court grants.
