NEW YORK (Legal Newsline) — A New York City consumer has filed a class action lawsuit against Johnson & Johnson, alleging fraud and negligent misrepresentation.
Suzanna Bowling filed a complaint, individually and on behalf of all others similarly situated, May 25 in U.S. District Court for the Southern District of New York against Johnson & Johnson and McNeil Nutritionals, LLC, alleging that they made false representations to consumers the actual contents of their spread products.
According to the complaint, Bowling was damaged financially from being misled into purchasing a falsely labeled Benecol Regular Spread product. The plaintiff alleges the defendants labeled their product to be free of trans fats and trans fatty acids despite having hydrogenated oils.
Bowling seeks trial by jury, compensatory, statutory and punitive damages, pre-judgment interest, restitution, injunctive relief, attorney fees and court costs.
