Lawsuit alleges cruise company violated phone privacy laws

SAN DIEGO (Legal Newsline) — A California man has filed a class action lawsuit against a cruise company, alleging violation of telephone harassment statutes.

John McCurley of San Diego County filed a complaint, individually and on behalf of all others similarly situated, May 12 in U.S. District Court for the Southern District of California against Royal Seas Cruises Inc. alleging the defendant illegally called the plaintiff several times on his cellular telephone.

According to the complaint, in 2013, McCurley suffered damages from receiving several unwanted calls. The plaintiff alleges Royal Seas Cruises kept calling McCurley despite his request to stop calling him in violation of the Telephone Consumer Protection Act.

McCurley seeks a trial by jury, $500 in statutory damages, injunctive relief, $1,500 in treble damages and any other just relief. He is represented by attorneys Joshua Swigart and Kevin Lemieux of Hyde & Swigart in San Diego, and by Abbas Kazerouni of Kazerouni Law Group APC in Costa Mesa, California.
