Subscriber accuses Cablevision of false advertising

BROOKLYN, N.Y. (Legal Newsline) — A New York subscriber has filed a class action lawsuit against Cablevision, alleging negligent misrepresentation.

Christopher Krafczek filed a complaint, individually and on behalf of all others similarly situated, March 30 in Nassau County Superior Court against Cablevision System Corporation and Neptune Holdings US Corp., doing business as Altice USA, alleging the cable company changed its billing practices for consumers in order to add to its profit.

The defendant removed the case to U.S. District Court for the Eastern District of New York on May 12.

According to the complaint, Krafczek, a Cablevision customer between December 2014 and December 2016, was damaged financially because the defendants failed to inform consumers regarding changes in their billing practice.

Krafczek seeks restitution and disgorgement, designating the plaintiff as class representative, actual, statutory and punitive damages, interest, attorney fees and all other just relief. He is represented by attorneys Marisa K. Glass John A. Yanchunis of Morgan & Morgan Complex Litigation Group in Tampa, Florida.
