Consumer accuses vitamin supplement company of negligent representation

BROOKLYN, N.Y. (Legal Newsline) — A New York consumer has filed a class action lawsuit against a vitamin supplement company, alleging negligent misrepresentation.

Stefania Daidone Maniaci of Nassau County filed a complaint, individually and on behalf of all others similarly situated, May 17, in the U.S. District Court for the Eastern District of New York against Now Health Group, Inc. alleging false representations regarding the amount of active ingredients in its products.

According to the complaint, Maniaci was damaged monetarily from purchasing a falsely advertised product. The plaintiff alleges Now Health Group negligently labeled its supplement product that did not contain consistent amounts of its active ingredient hypericin.

Maniaci seeks trial by jury, enjoin the defendant, actual damages, punitive damages, statutory damages, attorney fees, pre- and post-judgment interest and all just and proper relief. She is represented by Michael J. Gabrielli of Gabrielli Levitt LLP in Bronx, New York.
