SANTA ANA, Calif. (Legal Newsline) — A New Jersey man has filed a class action lawsuit against a California company, alleging violation of telephone harassment statutes.
Frank Eisenband filed a complaint, individually and on behalf of all others similarly situated, May 16 in the U.S. District Court for the Central District of California-Southern Division against Carguardian Warranty LLC, doing business as Carguardian, alleging the defendant illegally called the plaintiff on his cellular telephone to promote its services.
According to the complaint, in April, Eisenband was damaged from receiving unwanted calls on his cellular telephone. The plaintiff alleges Carguardian made several calls to his cellular telephone despite his request to stop calling.
Eisenband seeks trial by jury, actual and statutory damages, court costs and all relief the court grants. He is represented by attorney Seth M. Lehrman of Farmer, Jaffe, Weissing, Edwards, Fistors & Lehrman PL in Fort Lauderdale, Florida.
