Oakland environmental groups accuse EPA administrator of breach of duty

WASHINGTON (Legal Newsline) — Two Oakland, Calif., environmental groups are suing the EPA administrator, alleging breach of duty and violation of federal law.

The Center for Biological Diversity and the Center for Environmental Health filed a complaint May 3 in U.S. District Court for the District of Columbia against EPA Administrator Scott Pruitt, alleging failure to perform his duty in respect to the 2008 ozone National Ambient Air Quality Standards (NAAQS).

According to the complaint, the plaintiffs were damaged on behalf of the general public. The plaintiffs allege Pruitt has failed to make a final determination whether the Philadelphia-Wilmington-Atlantic City attained the 2008 ozone NAAQS.

The plaintiffs seek an injunction against the EPA, court costs and all relief the court grants. They are represented by attorney Robert Ukeiley of Law Office of Robert Ukeiley in Boulder, Colorado.
