ATLANTA (Legal Newsline) — A Tennessee woman has filed a class action lawsuit against Arby's, alleging breach of contract, breach of duty and negligence.
Ashley Russell filed a complaint, individually and on behalf of all others similarly situated, April 28 in U.S. District Court for the Northern District of Georgia against Arby's Restaurant Group, Inc., alleging failure to to protect the plaintiff's debit card information.
According to the complaint, Russell was damaged from having her card's information collected without her knowledge. The plaintiff alleges Arby's failed to secure their customers' debit card number and other card date and personal information.
Russell seeks trial by jury, enjoin the defendant, equitable relief compelling Arby's to use appropriate methods and policies to secure their customers data, plus damages, attorney fees and all other relief the court deems just and proper.
