SACRAMENTO, Calif. (Legal Newsline) — Two consumers have filed a class action lawsuit against an olive oil producer, alleging negligent misrepresentation.
Jay Schiffman and Anthony Williams filed a complaint, individually and on behalf of all others similarly situated, May 3 in U.S. District Court for the Eastern District of California against Urbani Truffles USA Inc., alleging the defendant falsely labeled their olive oil products to make it look like they contained white and black truffles.
According to the complaint, Schiffman and Williams was damaged monetarily from being misled into purchasing a falsely labeled olive oil product. The plaintiffs allege Urbani Truffles misleads consumers into buying their product that is not made out of truffle oil at all.
The plaintiffs request a trial by jury and seek compensatory, statutory, punitive damages, injunctive relief enjoining the defendant, interest, restitution and other forms of monetary relief, and attorney fees and court costs.
