Three consumers accuse Tesla of making false claims about vehicles

SAN JOSE, Calif. (Legal Newsline) — Three consumers have filed a class action lawsuit against Tesla Motors, Inc., alleging fraud and unjust enrichment.

Dean Sheikh of Denver, John Kelner of Davie, Florida, and Tom Milone of New Jersey filed a complaint, individually and on behalf of all others similarly situated, April 19 in U.S. District Court for the Northern District of California San Jose Division against Tesla Inc., doing business as Tesla Motors Inc. alleging the defendant made false claims to the features of their vehicle.

According to the complaint, Sheikh, Kelner and Milone suffered damages from being misled into buying a vehicle that did not have the features as advertised. The plaintiffs alleges Tesla Motors defrauded consumers by selling vehicles to consumers that are equipped with defective standard safety features and defective enhanced autopilot.

The plaintiffs seek trial by jury, enjoin the defendant, injunctive relief, restitution, damages, punitive damages, penalties, and disgorgement, interest, all legal fees and all other relief the court deems just. They are represented by attorney Shana E. Scarlett of Hagens Berman Sobol Shapiro LLP in Berkeley, California.
