SACRAMENTO, Calif. (Legal Newsline) — A California consumer has filed a class action lawsuit against Wal-Mart, alleging fraud, unjust enrichment and violation of state law.
Brenna Ceja filed a complaint, individually and on behalf of all others similarly situated, April 20 in U.S. District Court for the Eastern District of California against Wal-Mart Stores Inc., alleging the defendant deceives consumers into buying its products with prices artificially inflated.
According to the complaint, Ceja was damaged monetarily from being misled into purchasing items that were advertised as discounted but was really being sold at their regular price. The plaintiff alleges Wal-Mart made false prices and discounts to their items in order to induce consumers into purchasing crayons, markers, sunscreen and a cellular phone.
Ceja seeks trial by jury, enjoin Wal-Mart from conducting unlawful business practices, provide remedy to unlawful business practices, restitution to consumers, pre- and post-judgment interest, disgorgement of all monies wrongfully obtained, damages to the plaintiff, and all other just and proper relief.
