SACRAMENTO, Calif. (Legal Newsline) — A subscriber has filed a class action lawsuit against a California company, alleging unfair competition and violation of state law.
Kyle Johnson filed a complaint, individually and on behalf of all others similarly situated, April 17 in the U.S. District Court for the Eastern District of California against Carbonite Inc., and Does 1-10, alleging they automatically renewed their computer services to the plaintiff without his consent.
According to the complaint, Johnson was damaged monetarily from having his cloud and data backup computer services automatically renewed without his permission. The plaintiff alleges the defendants failed to offer to the terms of the automatic renewal to Johnson before signing him up for the service.
Johnson seeks trial by jury, all damages, restitution, injunctive relief, attorney fees and court costs, plus all other appropriate relief. He is represented by attorneys Scott J. Ferrell and Victoria C. Knowles of Pacific Trial Attorneys in Newport Beach, California.
