Rockstar sued over amount in cans

PORTLAND, Ore. (Legal Newsline) — An Oregon consumer has filed a class action lawsuit against an energy drink business, alleging fraud, negligent misrepresentation, and unfair competition.

J Podawiltz filed a complaint, individually and on behalf of all others similarly situated, March 26 in U.S. District Court for the District of Oregon against Rockstar Inc., alleging the defendant misrepresents the actual amount of beverage contained in cans of its energy/coffee product.

According to the complaint, Podawiltz sustained monetary damages from being deceived into purchasing a falsely advertised canned beverage. The plaintiff alleges Rockstar advertises a can of their energy/coffee beverage to contain 473 milliliters when it actually does not contain that much beverage.

Podawiltz seeks trial by jury, an injunction against the defendant, actual, statutory, and punitive damages, interest, court costs and all further relief the court grants. He is represented by attorney Michael Fuller of Olsen Daines PC in Portland, Ore.
