Kiss My Face sued over body lotion

SAN FRANCISCO (Legal Newsline) — A San Francisco consumer has filed a class action lawsuit against a cosmetics company, alleging fraud, liability, negligent misrepresentation and product liability.

Andrew Gasser filed a complaint, individually and on behalf of all others similarly situated, March 27 in U.S. District Court for the Northern District of California against Kiss My Face LLC, alleging the defendant falsely promotes their product KMF body lotion to be able to "nourish naturally".

According to the complaint between 2015-17 Gasser paid a premium for a falsely advertised product. The plaintiff alleges Kiss My Face labeled and advertised its body lotion product to be able to "nourish naturally" despite containing phenoxyethanol and/or ethylhexylglycerin.

Gasser seeks trial by jury, to name the plaintiff as class and subclass representative, compensatory, treble, and punitive damages, injunctive relief enjoining the defendant, pre-judgment interest, restitution and all forms of equitable monetary relief, plus reasonable attorney fees and court costs. He is represented by attorneys L. Timothy Fisher, Joel D. Smith and Yeremey O. Krivoshey of Bursor & Fisher, P.C. in Walnut Creek, California.
