Consumer alleges PhD Fitness' supplements falsely advertised evidence backing ingredients

AIKEN, S.C. (Legal Newsline) — A consumer has filed a class action lawsuit against PhD Fitness LLC, citing alleged fraud and negligent misrepresentation.

John Sandviks filed a complaint on behalf of all others similarly situated on March 17 in the U.S. District Court for the District of South Carolina against PhD Fitness alleging that the California company made false claims about the benefits of its sport supplements.

According to the complaint, the plaintiff alleges that he suffered damages from being misled into purchasing a falsely advertised sport supplement. The plaintiff holds PhD Fitness responsible because the defendant allegedly falsely labels its product with statements that all of the ingredients used are supported by scientific studies and are dosed properly.

The plaintiff requests a trial by jury and seeks pay for actual damages, restitution, to enjoin the defendant, all legal fees, interest and any other relief as this court deems just. He is represented by Harper T. Segui of Kohn, Swift & Graf P.C. in Mount Pleasant, South Carolina.
