Woman sues Blistex, alleges defective tube design

CHICAGO (Legal Newsline) — A California woman is suing Blistex Inc. over allegations that the company's lip ointment containers render nearly a quarter of the ointment inaccessible to consumers. 

Alana Hillen filed a complaint on March 16, in the U.S. District Court for the Northern District of Illinois against Blistex, alleging fraud because the Illinois corporation sold its lip ointment in a defective tube design.

According to the complaint, the plaintiff alleges that she sustained damages from purchasing a lip ointment that has approximately 23 percent of it unusable due to the defective tube design. The plaintiff holds Blistex responsible because the defendant allegedly failed to inform the consumers of a defective tube design of its lip ointment.

The plaintiff requests a trial by jury and seeks statutory damages, compensatory damages, punitive damages, actual damages, restitution and interest, court costs and any further relief the court grants.
