Justice Department sues to block dietary supplement sales

WASHINGTON (Legal Newsline) — The U.S. District Court for the District of Colorado has entered a permanent injunction against EonNutra LLC, two related companies and owner Michael Floren to block the sale of allegedly adulterated and misbranded dietary supplements.

 

The U.S. Justice Department had claimed the defendants violated the Federal Food, Drug and Cosmetic Act (FDCA) by selling dozens of dietary supplement products that claimed to treat or prevent a host of serious conditions or diseases without U.S. Food and Drug Administration approval. The allegedly unapproved drugs included NOx2, HGH Night Time, rHGH Drops Black Label, Primal Rage Levo 5 GH Mass and Deer Antler Velvet Extract.

The injunction, which also covered the companies CDSM LLC and HABW LLC, was announced March 15.

 

“The Department of Justice will continue to work cooperatively with FDA so that consumers can be confident in the claims of sellers of drugs and dietary supplements,” said the acting assistant attorney general, Chad Readler, of the Justice Department’s Civil Division in a prepared statement. “Manufacturers need to ensure the quality and identity of the ingredients that go into their products, so that such products are safe for consumers and the public can rely on the integrity of those products.”
