Employees allege Starwood Hotels failed to pay wages, tips

HARRISBURG, Pa. (Legal Newsline) — Former hospitality workers have filed a class action lawsuit against Starwood Hotels & Resorts Worldwide LLC, claiming that the Pennsylvania resort operator failed to pay them minimum wages and overtime wages.

Chelsea Henkel, Lisa Hastings, Leonora Mocerino, Craig Mocerino and Lizeth Larkin filed a complaint on behalf of themselves and others similarly situated, on March 2 in the U.S. District Court for the Middle District of Pennsylvania against the defendant, alleging a breach of contract, unfair dealing and unjust enrichment..

According to the complaint, the plaintiffs have suffered damages as a result of the wrongful conduct of the defendant, which also failed to distribute the gratuities earned by the employees. The plaintiffs hold Starwood Hotels & Resorts Worldwide LLC responsible because the defendant allegedly denied plaintiffs income that is rightfully theirs and breached the written contract between the defendant and its customers, which mandates the gratuity fee.

The plaintiffs request a trial by jury and seek judgment against the defendant, declaratory relief, monetary and punitive damages, costs of action and further relief the court deems just. They are represented by Matthew Blit of Levine & Blit PLLC in New York.
