Customer alleges Walgreens overcharges for insulin pump supplies

CHICAGO (Legal Newsline) — An Illinois man is suing Walgreens, alleging fraud, unfair competition and unjust enrichment.

Robert Mayberry of Geneva, Illinois, individually and for others similarly situated, filed a complaint March 3 in U.S. District Court for the Northern District of Illinois against Walgreens Co., Albertson's Companies Inc., Supervalu, Inc. and CVS Pharmacy Inc., alleging they overcharge their patients for insulin pump supplies.

According to the complaint, Mayberry sustained financial damages as the result of being overcharged for insulin pumps. The plaintiff alleges the defendants charged him for insulin pump supplies when they were suppose to be covered.

Mayberry seeks trial by jury, damages, interest, impose a constructive trust on amounts collected from the plaintiff, reimburse the defendants' customers, court costs and all further relief the court grants. He is represented by attorney Shannon M. McNulty of Clifford Law Offcies in Chicago.
