Candy maker accused of shortchanging customers

LOS ANGELES (Legal Newsline) — A consumer has filed a class action lawsuit against a Pennsylvania candy manufacturer for allegedly shortchanging buyers on the amount of candy in its packages.

Stephanie Escobar of Los Angeles County filed a complaint on behalf of all others similarly situated earlier this year in the Superior Court for the State of California against defendants Just Born Inc. and related parties, alleging that they falsely advertised the contents of their Mike and Ike and Hot Tamales products.

The defendant removed the case to U.S. District Court for the Central District of California on March 7.

According to the complaint, the plaintiff alleges that she suffered damages from purchasing a falsely advertised product containing 46 percent empty space. The plaintiff holds Just Born, Inc. and others responsible because the defendants allegedly misled consumers into purchasing their packages, which are only 54 percent filled with candy.

The plaintiff requests a trial by jury and seeks damages, interest, restitution/disgorgement, punitive damages and all legal fees and any other relief as this court deems just. She is represented by Ryan Clarkson, Shireen Clarkson and Shalini Dogra of Clarkson Law Firm, P.C. in Los Angeles.
