Environmental groups allege EPA violated law

SAN FRANCISCO (Legal Newsline) — Environmental groups are suing the EPA, alleging breach of duty and violation of federal law. 

The Center for Biological Diversity, the Association of Irritated Residents, the Sierra Club and the Climate Change Law Foundation filed a lawsuit Feb. 13 in U.S. District Court for the Northern District of California against the U.S. Environmental Protection Agency and EPA officials Catherine McCabe and Alexis Strauss, alleging they failed to act upon the petition sent by the plaintiffs.

According to the complaint, the plaintiffs sustained damages from having no response to the petition they submitted. The plaintiffs allege the defendants failed to grant or deny the plaintiffs' petition within the mandatory 60-day deadline.

The plaintiffs seek an order for the defendants to perform their mandatory duty to grant or deny the petition, court costs and all relief the court grants. They are represented by attorney James M. Birkelund of Climate Change Law Foundation in San Francisco.
