Oakland consumer accuses Bayer of unfair competition

SAN FRANCISCO (Legal Newsline) — An Oakland consumer has filed a class action lawsuit against the Bayer pharmaceutical company, alleging breach of warranty, unfair competition and unjust enrichment.

Daniel Goldman filed a complaint, individually and on behalf of all others similarly situated, Feb. 8 in U.S. District Court for the Northern District of California against Bayer AG, Bayer Corporation, and Bayer Healthcare LLC, alleging they falsely represent the number of days worth of their multivitamins.

According to the complaint, Goldman sustained monetary damages from being misled into purchasing a falsely advertised product. The plaintiff alleges the defendants advertises their multivitamins to provide one day's worth of needed vitamin intake when the recommended service size is two servings per day.

Goldman seeks trial by jury, restitution, disgorgement, compensatory damages, punitive damages, interest, court costs and all further relief the court grants.
