LOS ANGELES (Legal Newsline) — A California consumer has filed a class action lawsuit against mobile phone businesses, alleging breach of implied warranty, breach of warranty, fraud, negligent misrepresentation, and unfair competition.
Oscar Herrera of Paso Robles, California, filed a complaint, individually and on behalf of all others similarly situated, Feb. 8 in U.S. District Court for the Central District of California against LG Electronics USA, Inc., LG Electronics Mobilecomm U.S.A., Inc., and Does 1 to 10, alleging they manufacture and sell V10 phones that are defective.
According to the complaint, on Oct. 30, 2015, Herrera purchased for $672 an LG V10 phone from a Verizon store in San Luis Obispo that suffers from bootloop. The plaintiff alleges the defendants refused to disclose the phone's defects to consumers or attempt to fix the problem with their phones.
Herrera seeks trial by jury, actual, general, special, incidental, statutory, punitive and consequential damages, interest, court costs and all further relief the court grants.
