LOS ANGELES (Legal Newsline) — A consumer has filed a class action lawsuit against a clothing and home goods retailer, citing alleged fraud, negligent misrepresentation and violation of California law.
Anthony Morales filed a complaint on Jan. 28 in the U.S. District Court for the Central District of California against Stein Mart Inc. and Does 1 through 10 alleging that the company falsely advertises the markdown prices of its products in its California stores.
According to the complaint, Morales alleges that he sustained damages from being misled into buying products that were labeled as marked down compared to other retailers. He holds Stein Mart responsible because it allegedly advertises its prices as discounted and marked down despite not providing the true market price of the product to deceive consumers into believing that they are saving money, the complaint states.
Morales requests a trial by jury and seeks compensatory and punitive damages, interest, restitution, injunctive relief, disgorgement, court costs and any further relief this court grants. He is represented by Reuben D. Nathan of Nathan & Associates APC in San Diego.
