Man claims Tradewinds Beverage falsely advertised products as all-natural

LOS ANGELES (Legal Newsline) — A Los Angeles man has filed a class-action lawsuit against Tradewinds Beverage Co.; Sweet Leaf Tea Co.; Nestle Waters North America, Inc.; and Does 1 through 25, citing alleged breach of implied warranty, breach of warranty, fraud and negligent misrepresentation.

Christopher Rhinesmith filed a complaint on behalf of all others similarly situated and the general public on Jan. 18 in the U.S. District Court for the Central District of California against the defendants, alleging that they made false claims about the ingredients used for their products.

According to the complaint, Rhinesmith alleges that he suffered damages from paying a premium price for products that were advertised as 100% natural. The plaintiff holds Tradewinds Beverage Co., Sweet Leaf Tea Co., Nestle Waters North America and Does 1 through 25 responsible because they allegedly advertise their product to contain 100% natural ingredients in order to deceive consumers into purchasing their beverages.

Rhinesmith requests a trial by jury and seeks order the defendant to correct, destroy and change all false labeling on their website relating to the natural claims, compensatory and punitive damages, interest, restitution, disgorgement, any other monetary relief, injunctive relief, all legal fees and any other relief as this court deems just.
