BROOKLYN, N.Y. (Legal Newsline) — A New York consumer is suing Nestle, alleging negligent misrepresentation.
Wendy Manemeit filed a class action complaint, individually and on behalf of all others similarly situated, Jan. 6 in U.S. District Court for the Eastern District of New York against Gerber Products Co., doing business as Nestle Nutrition, Nestle Infant Nutrition, and Nestle Nutrition North America, alleging they falsely advertised their baby food product as reducing the risk of developing allergies to infants.
According to the complaint, Manemeit suffered monetary damages from purchasing the falsely advertised Good Start baby food. The plaintiff alleges the defendants advertised that their product could reduce the risk of babies developing allergies even though the FDA had rejected their proposed health claim.
Manemeit seeks trial by jury, restitution and disgorgement, actual, statutory, punitive damages, interest, legal fees and all other relief the court deems just. She is represented by attorneys Michael R. Reese and George V. Granade of Reese LLP in New York, and by three other legal firms.
